(Pricing for the several services is at the bottom of this post.)
Its unfortunate, but most attorneys do not have the time or the budget to properly research your case. It doesn’t mean that they don’t want to, its just not possible in most situations. Also most attorneys practice several areas of law and are not always aware of the latest cases pertaining to foreclosure. This is where I come in.
I don’t give “legal advise”. But I do research your case and and offer various levels of research based findings that you can provide to your attorney or paralegal to save money for you and to make their job easier. Also my research focuses in on what I believe to be the strongest arguments as this time. Your attorney may then take my research and use it to make those arguments, as they apply, in your complaint.
What I do is to assist legal professionals; not to go around them or to “practice law without a license”, whatever than means… The court system looks down on Pro Se litigants and prejudices them from the start. So rather than fighting from that position, I find it more productive to help legal professions to be more productive and powerful. Also my work saves you money and increases their chances of winning for you. If you do decide to litigate Pro Se, my work helps to make your work more professional so you can more easily overcome the prejudices.
The basic levels of work I do are the following:
1. Coaching calls. I can get you to understanding the foreclosure process and what avenues exist for remedy, usually in a couple of hours in a coaching call. Before you do anything else, I can speak with you and get you up to speed on what this is all about, what can be done and what is working around the country. I do this in a manner that is self empowering and fully informative without giving you ” legal advise”.
2. Document analysis. There are basically two main types of real estate document analysis,. There are examinations by certified mortgage auditors which isolate federal claims such as RESPA and TILA breaches and then there is an inspection for fraud and mistake of the public title records. I perform the later. I can refer you to a certified auditor who will search for evidence of predatory lending, but before that is even considered, I inspect your land title records for details that indicate who the pertinent parties are, mistake in the document content, and fraud in the execution of those documents. The results of this examination will very much shape the direction of many claims you may wish to pursue. If a securitization claim is to be used in the future, this examination can often reveal the location of important documents to assist your attorney in making that claim.
3. Production of extensive legal research findings to assist your attorney or paralegal. I collect up all the pertinent cases and information your attorney or paralegal needs to draft a complaint or to present a counterclaim to a foreclosure. This can include information about individuals who have executed documents, corporate mergers that effect standing, state based consumer statutes, securitization trusts and the parties to that sccuritization platform, and a wide variety of information pertaining to your situation. What I produce is comprehensive and thorough. Attorneys repeatedly thank me for doing this work because it makes their job so much easier and helps them to create a much more targeted and succinct complaint.
4. Ongoing trusteeship. In this instance, I take on your cause and conduct ongoing and ever unfolding research. Each case is its own journey and I work with you and your attorney or paralegal to investigate and build your claims over the life of the case or until its time for me to step out.
5. Custom work for specific needs. SEC searches, Bloomberg Terminal searches, custom letters and other resources that you can use to perform a specific task. Some tasks I perform, some I consign out.
E mail me with your needs and I will let you know what I might be able to do to help. If I need to refer you, I will do that. You will need some kind of moderate budget to defend against a foreclosure, but I understand that excessive funds are not so readily accessible and that work needs to be done at a reasonable rate. I try to work within your total budget so that you can afford your entire defense. I am very reasonable and my work always saves you money in the long run.
As described above, there are several options in regards to working with me. But there are three main capacities that are easily priced.
The first is a 1.5 hour coaching call. In this call, I will address all of your foreclosure related questions and bring you up to speed on the options that I believe are the most useful and productive. For this call, I ask for a 100 dollar donation.
The second service is a document analysis and production of a detailed report for your attorney. I analyze your county recorder documents to search for mistake, fraud, and to see if there are missing items that will give you standing to stall a foreclosure through the courts. I also look at your state’s foreclosure and real property laws and compare what is there with what is actually being done by the foreclosing entities. I then use a legal database search engine and pull up relevant case law that you can give to your attorney. The final result is document that has what is needed to create an injunction to stop a foreclosure. The final outcome will depend on your attorney and your particular situation, but this will arm him with the core info.
If you are going to go to court Pro Se, I can refer you to a paralegal to write up your pleadings. If you have an attorney, you can send the report to him. This service is $250 and is best used in conjunction with the call. I’ll also combine the call and the custom report together for $300 if you like.
The third service is ongoing trusteeship where I act as your long term researcher and I work directly with your attorney. This service will range between 4 and 600 per month but I only have time for 3 or 4 folks at any one time.
As you can see, I am very affordable. I know that folks facing foreclosure do not have a lot of liquidity and I bend over backwards to get you powerful and useful information.
